1. Acceptance of Terms
By accessing, browsing, or using the SixStores website, mobile application, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the Republic of Uganda.
If you do not agree to these Terms, you must immediately cease using the Platform. Your continued use constitutes irrevocable acceptance.
You must be at least 18 years of age to use SixStores. By using the Platform, you represent and warrant that you meet this requirement.
2. Definitions
- "SixStores", "we", "us", "our" -- SixStores Limited, the operator of the Platform
- "User", "you", "your" -- any person who accesses or uses the Platform, whether as a buyer, visitor, or vendor
- "Vendor" -- an independent third-party seller approved to list and sell products on the Platform
- "Buyer" -- a User who purchases products through the Platform
- "Platform" -- the SixStores website, mobile application, APIs, and all associated services
- "Content" -- all text, images, reviews, ratings, descriptions, and other materials uploaded to the Platform
- "UGX" -- Ugandan Shillings, the official currency
3. User Accounts
3.1 Registration
To make purchases, you must create an account with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activities under your account.
3.2 Account Security
You must notify SixStores immediately of any unauthorised use of your account. SixStores shall not be liable for any loss arising from your failure to safeguard your account credentials, including sharing passwords or using weak passwords.
3.3 One Account Policy
Each individual may maintain only one account. SixStores reserves the right to merge, suspend, or terminate duplicate accounts without prior notice and to forfeit any loyalty points, coupons, or credits associated with duplicate accounts.
4. Marketplace Model
SixStores operates as an online marketplace platform. We provide the technology, infrastructure, and audience; independent vendors list and sell their products through our Platform.
Important: SixStores is not the seller of products listed by vendors. Each vendor is independently responsible for product quality, accuracy of descriptions, warranties, and compliance with applicable Ugandan laws including the Sale of Goods Act and the Consumer Protection Bill. SixStores facilitates the transaction but does not manufacture, warehouse, or independently verify all products.
SixStores reserves the right to curate, moderate, approve, or reject any product listing at our sole discretion without obligation to provide reasons.
5. Orders & Pricing
5.1 Pricing
All prices are displayed in Ugandan Shillings (UGX) and include applicable fees. Prices are set by vendors and may include a marketplace service fee. SixStores reserves the right to modify service fees without prior notice.
5.2 Order Acceptance
Placing an order constitutes an offer to purchase. SixStores and/or the vendor reserve the right to accept or reject any order for any reason, including but not limited to: product unavailability, pricing errors, suspected fraud, or failure of payment verification.
5.3 Pricing Errors
In the event of a pricing error, SixStores reserves the right to cancel the order and issue a full refund. We are not obligated to honour incorrect prices, regardless of whether the order has been confirmed.
5.4 Stock Availability
Product availability is not guaranteed. If an ordered item becomes unavailable after payment, we will offer a full refund or a suitable alternative at the Buyer's election.
6. Payments
6.1 Accepted Methods
We accept MTN Mobile Money, Airtel Money, and such other payment methods as may be introduced. All payments must be completed before orders are dispatched.
6.2 Payment Security
All payment transactions are encrypted and processed through authorised payment service providers regulated by the Bank of Uganda. SixStores does not store your Mobile Money PIN or full payment credentials.
6.3 Transaction Fees
Mobile Money transaction fees may be charged by your provider. SixStores is not responsible for any fees imposed by your payment provider.
6.4 Currency
All transactions are conducted in UGX. SixStores does not accept foreign currencies.
7. Delivery
7.1 Delivery Areas
We deliver across Uganda. Delivery timelines vary by location: same-day or next-day within Kampala; 2-5 business days upcountry. These are estimates only and not guarantees.
7.2 Delivery Risk
Risk of loss and title for purchased items passes to you upon delivery to the address specified in your order. SixStores is not responsible for items lost, stolen, or damaged after delivery confirmation.
7.3 Delivery Fees
Delivery fees are calculated based on location, weight, and order value. Free delivery promotions are subject to conditions specified at the time of the offer.
7.4 Failed Delivery
If delivery fails due to incorrect address, unavailability of the recipient, or refusal to accept, SixStores may charge an additional re-delivery fee. After two failed delivery attempts, the order may be cancelled and a refund issued minus delivery costs incurred.
7.5 Discreet Packaging
Wellness and intimacy products are shipped in plain, unbranded packaging. This is a standard service and no additional fees apply.
8. Returns & Refunds
8.1 Return Window
Products may be returned within 7 days of delivery, provided they are in original, unopened condition with all tags, packaging, and accessories intact.
8.2 Non-Returnable Items
The following products are not eligible for return or refund:
- Intimate/personal wellness products (for hygiene reasons)
- Perishable goods
- Digital products or gift cards
- Products that have been used, damaged by the buyer, or altered
- Products sold as "Final Sale" or "Non-Returnable"
8.3 Refund Processing
Approved refunds will be processed within 7-14 business days via the original payment method. SixStores reserves the right to deduct return shipping costs, restocking fees (up to 15% of product value), or any applicable charges from the refund amount.
8.4 Damaged or Defective Items
If you receive a damaged or defective item, contact us within 48 hours with photographic evidence. SixStores will arrange a replacement or full refund at our discretion.
8.5 Dispute Resolution for Returns
SixStores has final discretion on all return and refund decisions. Our assessment of product condition and eligibility is binding.
9. Loyalty Programme
9.1 Earning Points
Registered users earn loyalty points on eligible purchases, reviews, referrals, and promotional activities. Point earning rates are determined by SixStores and may be modified at any time without prior notice.
9.2 Redeeming Points
Points may be redeemed for discounts on future purchases, subject to minimum thresholds and redemption rates set by SixStores. Points have no cash value and cannot be transferred, sold, or exchanged for cash.
9.3 Expiry & Forfeiture
Points expire 12 months from the date of issuance if not redeemed. SixStores reserves the right to adjust point balances, expire points, modify earning rates, or discontinue the loyalty programme entirely at its sole discretion without liability.
9.4 Abuse
Any attempt to manipulate, exploit, or abuse the loyalty system (including creating fake accounts, fraudulent referrals, or gaming review points) will result in immediate forfeiture of all points and potential account termination.
10. Vendor Terms
10.1 Vendor Obligations
Vendors must provide accurate product descriptions, maintain adequate stock, fulfil orders promptly, and comply with all applicable Ugandan laws, including tax obligations, product safety standards, and consumer protection requirements.
10.2 Commission & Fees
SixStores charges vendors a commission on each sale. Commission rates are set at SixStores' discretion and communicated to vendors. SixStores reserves the right to modify commission rates with 14 days' notice.
10.3 Payment to Vendors
Vendor payouts are processed according to the payout schedule communicated during onboarding, less commissions, refunds, chargebacks, and any applicable deductions.
10.4 Vendor Suspension
SixStores may suspend or terminate a vendor's account for any reason, including poor performance, customer complaints, policy violations, or at our sole discretion. Pending payouts may be withheld during investigation of disputes.
11. Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information
- Use the Platform for any unlawful purpose under the laws of Uganda
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or systems
- Scrape, harvest, or collect data from the Platform using automated means
- Interfere with or disrupt the Platform, servers, or networks
- Post defamatory, obscene, threatening, or discriminatory content
- Manipulate reviews, ratings, or loyalty points
- Engage in price manipulation, bid rigging, or anti-competitive behaviour
- Circumvent or attempt to circumvent any security measures, fees, or restrictions
- Use the Platform to facilitate money laundering, terrorism financing, or any financial crime
Violation of these prohibitions may result in immediate account termination, forfeiture of balances, and referral to law enforcement authorities.
12. Intellectual Property
All content, design, logos, trademarks, software, and technology on the Platform are the exclusive property of SixStores Limited or its licensors and are protected under Uganda's Trademarks Act, Copyright and Neighbouring Rights Act, and international intellectual property treaties.
By posting reviews, ratings, images, or other content, you grant SixStores a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media for any purpose, including marketing and promotional activities.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UGANDAN LAW:
- THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SIXSTORES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- SIXSTORES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF THE PLATFORM.
- SIXSTORES' TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO SIXSTORES IN THE 3 MONTHS PRECEDING THE CLAIM, OR UGX 500,000, WHICHEVER IS LESS.
- SIXSTORES IS NOT LIABLE FOR PRODUCT DEFECTS, VENDOR MISREPRESENTATION, DELIVERY DELAYS CAUSED BY THIRD PARTIES, OR ACTS OF GOD.
14. Indemnification
You agree to indemnify, defend, and hold harmless SixStores Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your content or materials posted on the Platform
- Any dispute between you and a vendor
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal proceedings, you must contact SixStores at legal@sixstores.ug and attempt good faith resolution for a minimum of 30 days.
15.2 Mediation
If informal resolution fails, the dispute shall be referred to mediation administered by the Centre for Arbitration and Dispute Resolution (CADER) in Kampala, Uganda.
15.3 Arbitration
If mediation fails, the dispute shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act of Uganda, conducted in Kampala. The language of arbitration shall be English. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
15.4 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Uganda. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Uganda.
15.5 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16. Termination
SixStores may terminate, suspend, or restrict your access to the Platform at any time, for any reason, with or without cause and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, suspected fraud, extended inactivity, or any conduct that SixStores deems harmful to the Platform or its users.
Upon termination: (a) all licences granted to you cease immediately; (b) loyalty points, credits, and unredeemed rewards are forfeited; (c) SixStores may retain your data as required by law or legitimate business interests; (d) provisions that by their nature should survive termination shall continue in full force and effect, including Sections 12, 13, 14, 15, and this Section 16.
17. General Provisions
17.1 Amendments
SixStores reserves the right to modify these Terms at any time. Material changes will be communicated via the Platform or email. Continued use after notification constitutes acceptance.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17.3 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental policies, constitute the entire agreement between you and SixStores regarding the use of the Platform.
17.4 No Waiver
Failure by SixStores to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.5 Assignment
SixStores may assign its rights and obligations under these Terms without your consent. You may not assign or transfer your rights without SixStores' written consent.
17.6 Force Majeure
SixStores shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, pandemics, war, government actions, power failures, internet disruptions, or strikes.
